TECHNOLOGY NEWS: EU divided over how to end mobile roaming charges

BRUSSELS (Reuters) - Agreeing on the best way to end mobile roaming charges in Europe is proving a difficult task among EU member states who are keen to deliver on their commitment to consumers but unsure of how to go about it.

Representatives from the EU's 28 member states discussed a proposal from Italy, which holds the rotating presidency of the European Council, at a meeting on Thursday which laid bare the disagreements over the time scale for bringing an end to the fees for using mobile phones in other EU countries.

"Member states have a bit of a stomach ache," said one EU diplomat who was at the meeting, referring to roaming charges.

Outgoing EU telecoms commissioner Neelie Kroes had made ending such charges for people using their phones across borders inside the bloc a banner element in a package to overhaul the ailing telecoms sector and spur the continent's big operators like France's Orange and Germany's Deutsche Telekom to invest in faster networks.

In April EU lawmakers gave it a ringing endorsement by overwhelmingly voting to abolish roaming fees by Dec. 15 2015.

But the Italian proposal, seen by Reuters, makes no mention of the date originally set by the European Parliament.

"The legislative date for the initial introduction of RLAH (roam like at home), subject to transitional measures and fair use limits, needs to be defined and is a significant political question," the draft document states.

Italy's undersecretary for telecoms Antonello Giacomelli reaffirmed on Friday his government's commitment to setting a date for abolishing roaming charges, a common headache for Europeans traveling across the continent.

"The Italian presidency has not proposed any delay to the end of roaming charges, on the contrary it intends to set a fixed date," he said in a statement.

"To this end it is trying to reach the best compromise between the different positions," he added.

ROAM LIKE AT HOME, UP TO A POINT

Though the draft will be further revised, it suggests a "glidepath", or gradual increase in the usage allowances that will be charged at domestic rates, towards the goal of "roam like at home" (RLAH) - a time where someone using, say, a British mobile phone in Italy will pay the same charges as if they were still in Britain.

But some countries are worried that spelling out exactly how gradually roaming fees should come to an end is too prescriptive and should be left to national regulators.

"It's very split," said another EU diplomat.

"Some member states ... are concerned about the investment effect it could have on their operators and therefore quite cautious about doing anything which they feel may harm some of their large incumbents."

Telecoms operators have protested against the end of roaming, although in private they admit that the fees must come to an end. However they say that doing so prematurely would remove a source of revenue that could hinder their ability to invest in upgrading their networks.

In a move seen as aimed at assuaging operators, the latest text under discussion foresees that users would pay domestic rates for using their mobile phone abroad only for a limited amount of consumption, the so-called 'fair use'. Anything above that would be charged at a higher rate.

"The possibility of introducing a fair use clause has been well received by all member states," Giacomelli said, adding that it would require further work.

The daily fair use limits for mobile phones would be calculated on the basis of "average annual domestic consumption in the EU".

The text suggests that "in an initial period the minimum fair use limit would be defined as a fraction of the daily average domestic consumption", and would gradually rise so as to fully reflect average daily use. It does not spell out how long the process would take.

Italy sees the "fair use" mechanism as a way to avoid people abusing the system, such as by purchasing SIM cards in EU countries where tariffs are lower, and then using them in countries where fees are higher.

Operators fear this could lead to an over-competitive internal market for mobile phones and a damaging drop in rates.

BUSINESS NEWS: Airlines cleared for mobile phone use during flights

From the section Business

The European Aviation Safety Agency (EASA) says electronic devices such as mobile phones can be left switched on during flights.

EASA says that electronic devices do not pose a safety risk.

The announcement clears the way for airlines to permit the use of mobile phones, once they have conducted their own safety reviews.

Currently airline passengers have to switch devices to flight mode and make calls from the airport terminal.

The EASA sets the framework for airlines making safety decisions.

The agency said each airline would still have to go through an assessment process, ensuring aircraft systems are not affected by the signals from portable electronic devices before establishing their own rules for their operation.

As a result there could be a delay in implementing the new rules at some airlines.

It also says that airlines may opt for different policies on the use of mobile devices.

Analysis: Richard Westcott, Transport Correspondent

This move strips away the last regulatory hurdle stopping airline passengers in Europe from making phone calls or using wi-fi on any flight, even while taxiing.

But that doesn't mean you'll have to endure the bloke next to you babbling on about his work for an hour during your next flight.

First of all, you can't get a signal at 33,000 feet. Not yet anyway.

Secondly, the airlines will need to pay to kit out their planes so that phones and wi-fi work. And thirdly, there's the passengers.

British Airways, for example, already has a business-class-only flight from London to New York that lets passengers use wi-fi and send texts.

But they block voice-calls, because whenever they survey passengers, most baulk at the idea of everyone around them talking on the phone during a flight.

Airliners remain one of the last places work can't get hold of you on the phone.

POLITICAL NEWS: Palestinian leader accuses Israel of 'genocide' at UN

Palestinian President Mahmoud Abbas received loud applause throughout his speech Palestinian Authority President Mahmoud Abbas has accused Israel of carrying out a "war of genocide" in Gaza in his speech at the UN General Assembly.

Mr Abbas said Israeli "war crimes" in Gaza should be punished, but stopped short of saying he would take the issue to the International Criminal Court.

His speech brought strong condemnation from Israel and from the US, which described it as "offensive".

The 50-day conflict left about 2,100 Palestinians and 73 Israelis dead.

Correspondents say the conflict has weakened Mr Abbas politically, with his rivals in the radical group Hamas, which dominates Gaza, seeing a surge of popularity among Palestinians for fighting Israel.

The UN says that most of the Palestinian dead were civilians. Israel says the high civilian death toll was because of Hamas fighters launching attacks from residential areas, including schools and mosques, drawing return fire.

Earlier this month Israel ordered a criminal investigation into five incidents in which civilians are believed to have died, and is investigating over 100 incidents in total.

'Fundamental questions'
Mr Abbas said the scale of damage in Gaza was unprecedented and surpassed that of earlier wars.

"This last war against Gaza was a series of absolute war crimes carried out before the eyes and ears of the entire world, moment by moment," he told the UN General Assembly in New York.

He added that it was "impossible" to return to negotiations with Israel that did not address what he called "fundamental questions".

"There is no meaning or value in negotiations for which the agreed objective is not ending the Israeli occupation and achieving the independence of the State of Palestine with East Jerusalem as its capital on the entire Palestinian Territory occupied in the 1967 war," he said.

Israeli Foreign Minister Avigdor Lieberman said it was a "speech of incitement filled with lies". He said Mr Abbas's remarks "highlight once again how he does not want and cannot be a partner for a reasonable diplomatic agreement".

He went on to accuse the Palestinian leader of "diplomatic terrorism".

More than 100,000 people were left homeless by the recent 50-day conflict

Israel says militants deliberately fired at it from civilian sites US State Department spokeswoman Jen Psaki said President Abbas's speech "included offensive characterisations that were deeply disappointing".

"Such provocative statements are counterproductive and undermine efforts to create a positive atmosphere and restore trust between the parties," she said.

Mr Abbas has previously threatened to take Israel to the International Criminal Court, but did not mention the body in his speech.

The Palestinian leader also said the "hour of independence of the state of Palestine" had arrived. He added that he would be seeking a UN Security Council resolution on a two-state solution, but gave no time frame.

The Israeli delegation was not present in the hall during Mr Abbas's speech.

Israel launched a major military operation in Gaza on 8 July, with the stated aim of stopping militants firing rockets and mortars at its territory.

Following several short-lived ceasefires, both sides agreed to an open-ended truce on 26 August which has so far held.

FOOTBALL NEWS: Van Gaal ideas 'too much' for team

Louis van Gaal has attempted to makes changes in his first two months at Manchester United Louis van Gaal has admitted that his Manchester United squad are struggling to get to grips with his ideas.

The Dutchman has presided over the club's worst Premier League start, with United going into Saturday's meeting with West Ham having collected just five points from five matches.

"We give [the players] a lot of information," Van Gaal said.

"There shall be a moment in the season that this information is not too much. At this moment maybe it is too much."

Since taking charge on 16 July, Van Gaal has experimented with different formations and made several alterations at the club's training ground in an attempt to implement his "philosophy".

The former Ajax, Barcelona and Bayern Munich coach is adamant that the club will benefit but has conceded that he may have pushed his players too far, too soon.

"You have to work out that information," said the United manager, who acknowledged that fans are already "very tired" of hearing his pleas for patience.

"It's very difficult because we are starting with a new team and a new relationship between players so that's why it needs time."

Van Gaal revealed United have only one senior centre-back available for Saturday's game.

That means Marcos Rojo could be partnered by either Tom Thorpe, 21, or Paddy McNair, 19, neither of whom have appeared for the first team.

SPORTS NEWS: Captains shake it up for Ryder Cup foursomes

GLENEAGLES Scotland (Reuters) - Captains Paul McGinley and Tom Watson shook up their teams when announcing their pairings for Friday's foursomes meaning all 12 players from each side will see action on the opening day of the 40th Ryder Cup.

Europe skipper McGinley handed a first Ryder Cup appearance to Frenchman Victor Dubuisson who will partner former U.S. Open champion Graeme McDowell for a daunting match against Phil Mickelson and Keegan Bradley.

Mickelson and Bradley secured a thrilling victory on the 18th green over Rory McIlroy and Sergio Garcia in the last fourballs match to give the United States a 2 1/2 - 1 1/2 lead.

Watson turned to experienced duo Jim Furyk and Matt Kuchar, both of whom sat out the morning fourballs, to face rookie Jamie Donaldson and Ryder Cup veteran Lee Westwood in the afternoon's opening match.

He surprisingly rested both newcomers Jordan Spieth and partner Patrick Reed who demolished Ian Poulter and Stephen Gallagher 5&4 in the morning.

Englishman Poulter, Europe's talisman and hero from Medinah two years ago when Europe retained the trophy, was rested.

Justin Rose and Henrik Stenson, who won the first point of the match for Europe with an easy win over off-form Bubba Watson and Webb Simpson, will take on Hunter Mahan and Zach Johnson who took no part in the fourballs.

World number one McIlroy resumes in the afternoon with Garcia against Rickie Fowler and Jimmy Walker who scrambled a vital half point against Thomas Bjorn and Martin Kaymer earlier in the day.

Pairings: (Europe first, times GMT)

12:15 (8.15 a.m. EDT) - Donaldson/Westwood v Furyk/Kuchar

12:30 (8.30 a.m. EDT) - Rose/Stenson v Mahan/Johnson

BUSINESS NEWS: Citigroup, Argentina bond holdouts argue over $5 million payment: hearing

NEW YORK (Reuters) - Creditors suing Argentina over defaulted debt battled with Citigroup Inc (C.N) in a Manhattan federal courtroom on Friday over the bank's request to process a $5 million payment due September 30 on bonds issued under Argentina's local laws.

Karen Wagner, a lawyer for the bank, told U.S. District Judge Thomas Griesa that "the plaintiffs have now consented to us making" the $5 million payment.

But bondholders that did not participate in Argentina's past restructurings and want to be paid in full for their bonds, including Elliott Management's NML Capital Ltd and Aurelius Capital Management, have opposed letting Citigroup make the payment, citing an earlier order by Griesa.

Ted Olson, a lawyer for NML, said allowing the payment would "frustrate any effort at settlement" with Argentina, which has been in default on a variety of bond payments for nearly two months, and encourage the country to evade further court orders.

Citigroup has said it faces regulatory and criminal sanctions by Argentina if it cannot process the interest payment on U.S. dollar-denominated bonds issued under Argentine law following the country's 2002 default.
