TECHNOLOGY NEWS: Apple $450 million e-book settlement wins court approval

NEW YORK (Reuters) - Apple Inc (AAPL.O) on Friday won preliminary court approval for its $450 million settlement of claims it harmed consumers by conspiring with five publishers to raise e-book prices.

In approving the accord, U.S. District Judge Denise Cote in Manhattan overcame concerns she had expressed over a settlement provision allowing Apple to pay just $70 million if related litigation were to drag out.

Apple has been appealing Cote's July 2013 finding, in a case brought by the U.S. Department of Justice, that it violated antitrust laws for colluding with the publishers to drive up e-book prices and impede rivals such as Amazon.com Inc (AMZN.O).

In June, Apple agreed to settle related class-action litigation brought on behalf of consumers and 33 U.S. states.

That accord calls for Apple to pay $400 million to consumers and $50 million to lawyers if the federal appeals court in New York upholds Cote's findings, and nothing if the Cupertino, California-based company wins its appeal.

But if the appeals court overturns Cote and returns the case to her, perhaps for a new trial, Apple will owe $50 million to consumers and $20 million to lawyers.

During a July 24 teleconference, Cote called that last scenario "most troubling."

But in Friday's decision, she noted that the states and consumers "strongly believe" such a scenario is unlikely, and that the settlement has provisions to reduce its likelihood.

She also said the plaintiffs agreed to provide more details about the settlement to consumers, to help them decide whether to accept its terms or sue Apple separately.

"The proposed settlement agreement is within the range of those that may be approved as fair and reasonable, such that notice to the class is appropriate," Cote said. "Preliminary approval is granted."

Cote set a final fairness hearing for Nov. 21.

The publishers are Lagardere SCA's (LAGA.PA) Hachette Book Group Inc, News Corp's (NWSA.O) HarperCollins Publishers LLC, Penguin Group (USA) Inc, CBS Corp's (CBS.N) Simon & Schuster Inc and Verlagsgruppe Georg von Holtzbrinck GmbH's Macmillan. They previously agreed to pay $166 million to consumers.

The case is In Re: Electronic Books Antitrust Litigation, U.S. District Court for the Southern District of New York, No. 11-md-02293.

TECHNOLOGY NEWS: Film world's cast of toys teleport into digital playground

LOS ANGELES (Reuters) - Those ubiquitous Angry Birds flew from the mobile screen to the toy store, hooked up with Hollywood, and are headed back to the digital world thanks to the telepod.

That is toymaker Hasbro Inc's answer to merging the physical and digital worlds of children's play in what the industry calls "toys-to-life." And like another leading toy company, Walt Disney Co, they are finding fans among the fervent audiences for action and superhero films.

Hasbro's Angry Bird telepods were a big attraction last weekend at San Diego's Comic-Con, an annual gathering of 130,000 comic and entertainment enthusiasts, with fans lining up to preview new Transformers-themed bird figurines containing miniscule codes that can be read by tablets.

The Angry Birds Transformers telepods, featuring "Autobirds" and "Deceptihogs," is due out on October 15, spinning off the success of Paramount Pictures' June box office hit, "Transformers: Age of Extinction."

Licensed toys have become a key to extending the entertainment content revenue stream, with U.S. retail sales in 2013 of $5.3 billion, according to research company The NPD Group.

In the first quarter of 2014, the top licensed toys included Disney's princess lines and "Frozen" toys, which helped Disney bring in $885 million in consumer products revenue, about 8 percent of the company's overall revenue during that time.

The new "toys-to-life" category grew 47 percent in a 12-month period ending June 2014 to $437 million in sales in the United States, according to NPD's gaming analyst Liam Callahan.

Retail analyst Stephanie Wissink at Piper Jaffray estimates that by 2018, 25 percent of toys will incorporate a digital component or integration with electronic devices.

'MOVING SEAMLESSLY'

"Kids enjoy both analog and digital play and they like moving seamlessly between the two," said John Frascotti, Hasbro's global chief marketing officer.

Using the bird and pig characters from Rovio Entertainment's Angry Birds mobile game app, consumers can place the physical figurine onto a plastic block and put it on a tablet's reader, which then recognizes the character via its magnetic code and imports it into the digital game.

Frascotti said Hasbro's 2015 line of Transformers robot toys will incorporate a digital element. The company is also likely to partner with Disney on toys tied to next year's anticipated "Star Wars" film, and Star Wars is already a top seller in the licensed toys market.

Disney made a loud entrance into the toys-to-life market with Disney Infinity, an interactive master game to which new characters and adventures are added.

With Marvel's "Captain America: The Winter Soldier" and "Guardians of the Galaxy" making a big splash at the box office this year, Disney is catering to the feverish demand for all things superhero by incorporating Marvel characters into Disney Infinity as of Sept. 23.

Consumers can buy collectible figurines of Disney characters such as Elsa from Oscar-winning hit "Frozen" or Marvel's Captain America, which have discs embedded with data chips that when placed on the Infinity Reader, can import the figure in the game. As characters advance through the digital game, the information is saved into the figurine.

"Physical toy sets are definitely not fading out," said Peter Phillips, senior vice president and general manager of Marvel's digital media group.

"The fact that we integrated a toy line as part of the game just shows that the two can work hand in hand very closely together."

EXCLUSIVE NEWS: Liberian Boy Survives Ebola Virus Infection

Ten-year-old William Benedict, one of the clinic's success stories, has made a full recovery against the odds after catching the virus from his dying mother.

"I was near mama when she was sick. When she died, I got sick," William says as he prepares to leave the centre and return to his village.

James Kollie, the clinic's ambulance driver, explains that the boy's mother summoned her son to lie beside her as she was dying in bed, coughing, vomiting and generally presenting a grave risk to anyone nearby.

"I drove the vehicle that carried the team to pick him up. That day everybody was running from him. I shed tears for him," Kollie tells AFP.

On Friday the leaders of Liberia, Sierra Leone and Guinea agreed a $100 million emergency action plan to beef the response to Ebola.

Much of the cash will go on deploying medical workers. But the plan also includes provision to improve education throughout the Ebola zone straddling the three countries.

TOP NEWS Israel: Hamas will pay 'intolerable' price for more attacks

JERUSALEM (Reuters) - Israeli Prime Minister Benjamin Netanyahu threatened on Saturday to exact an "intolerable price" from the Gaza Strip's dominant Hamas Islamists should there be continued attacks from the Palestinian territory.

"We do not accept a continuation of the shooting," Netanyahu told reporters. "It (Hamas) will have to understand, however long that takes, that it will pay an intolerable price, from its perspective, for continuation of the shooting."

EXCLUSIVE NEWS: Tekmira shares skyrocket as Ebola outbreak intensifies in Africa

(Reuters) - Shares of Canada's Tekmira Pharmaceuticals Corp , which hopes to produce the first treatment for the deadly Ebola virus, have skyrocketed as the worst-ever outbreak of the virus intensified in West Africa.

Though testing of the company's treatment TKM-Ebola on humans was put on hold last month due to safety concerns, investors scrambled to buy its stock, sending shares up 7.5 percent to $13.77 in Nasdaq trading Friday, and up more than 50 percent over the past fortnight.

"The recent outbreak in West Africa is as profound as any we have seen in recent decades," said Euro Pacific Canada analyst Douglas Loe.

"We have solid pre-clinical evidence showing that TKM-Ebola is effective at eradicating Ebola symptoms, giving us confidence that its development activities could resume," he said.

The outbreak forced Sierra Leone to declare a state of emergency and call in troops to quarantine victims on Thursday. The country joined neighbor Liberia in imposing tough controls as the death toll in West Africa exceeded 700.

Indeed, the outbreak is outpacing efforts to control it, but could be stopped, World Health Organization Director-General Margaret Chan said on Friday.

Ebola belongs to a family of viruses that can cause serious hemorrhagic fevers. There have been dozens of deadly outbreaks of the virus across West Africa, threatening people as well as endangered gorilla populations.

The recent outbreak, which has killed 729 people in four different countries since February, is the worst since the disease was discovered in the mid-1970s.

Tekmira had previously published proof-of-concept data that showed its treatment resulted in 100 percent protection from a lethal dose of Zaire Ebola virus in infected primates.

The company started an early-stage clinical trial for the treatment in January and was granted fast-track status from the U.S. Food and Drug Administration (FDA) on March 5, pushing shares to their highest ever a few days later.

The FDA's fast track is a process designed to facilitate and expedite the development and review of drugs to allow important new therapies to get to patients quickly.

The latest surge in Tekmira shares has come in the past 14 days, with shares soaring more than 52 percent over that period on the Nasdaq, including Friday's gains.

Those gains have come even as the treatment was put on clinical hold July 3, sending shares down more than 15 percent that day.

Tekmira officials weren't immediately available for comment.

"What Wall Street does is that it sees an Ebola crisis and it sees Tekmira with an Ebola medical countermeasure that has shown a 100 percent effectiveness in animals," said Maxim Group analyst Jason Kolbert.

"It says: 'Wow! This may be a really valuable product'."

Kolbert said he expected the hold to be lifted by year-end.

Analysts said the FDA would likely face pressure from global health campaigners to consider fast-tracking possible treatments, including Tekmira's.

A North Carolina physician petitioned the regulator on Wednesday on the Change.org website to release the hold on Tekmira's treatment. [http://chn.ge/1AHixDw ]

The petition has already gathered 12,500 signatures.

"Given that at least one patient has transferred the disease from Liberia to Nigeria by air travel, the possibility of a global pandemic becomes increasingly likely," said the petitioner, who identified himself as Ahmed Tejan-Sie, MD.

Last month, the director of the influential Wellcome Trust global charity said people at high risk of dying from the Ebola outbreak in West Africa should be offered experimental medicines to see if they work.

Tekmirawas incorporated in 2005, the result of a reorganization of its parent, Inex Pharmaceuticals Corp, which crashed when the FDA rejected its highly touted cancer drug.

Burnaby, British Columbia-based Tekmira has since specialized in the field of gene silencing, otherwise known as RNA interference.

All four brokerages covering the company's Nasdaq-listed stock have a "buy" or equivalent rating and an average price target of $26.63, about twice its current price. (Additional reporting by Sneha Banerjee in Bangalore; Editing by Bernadette Baum)

TOP NEWS Royal Jordanian airline suspends flights to Iraq on security concerns

AMMAN (Reuters) - Royal Jordanian, one of the main airlines serving Iraq, said on Saturday it had suspended all flights to Baghdad for at least 24 hours on security grounds.

The Jordanian state carrier was "monitoring security developments" in Iraq and would review the resumption of flights over Iraqi airspace on Sunday, said Basel Al Kilani, an airline spokesman.

Royal Jordanian until recently had an extensive network over Iraq, with a weekly total of 30 flights, serving Baghdad 11 times a week, as well as Basra in the south, and Irbil and Sulaymaniya in the Kurdish north.

It stopped its twice-weekly flights to Mosul shortly after the northern city fell in June to the Islamic State (IS) militant group.

Royal Jordanian's suspension follows similar action by other major airlines after the downing of Malaysia Airlines Flight MH-17 on June 17 over a conflict zone in eastern Ukraine with the loss of 298 people on board.

Air France-KLM, Britain's Virgin Atlantic [VA.UL], Air Berlin and Poland's LOT [LOT.UL] said earlier this week they had suspended flights over Iraq for security reasons.

Emirates [EMIRA.UL] had already said it was avoiding the area.. Germany's Lufthansa said it was avoiding certain areas of Iraq though sticking to frequently used paths. Abu Dhabi-based Etihad said it was still flying to and over Iraq, while Australia's Qantas was continuing to fly over the country, according to Australian media reports.

About 30 airlines temporarily suspended flights to Tel Aviv earlier this month to comply with a ban by the Federal Aviation Authority issued when hostilities erupted between Israel and the Palestinian militant organization Hamas. The ban has since been lifted.

BREAKING NEWS African leaders agree steps to fight runaway Ebola outbreak

CONAKRY (Reuters) - West African leaders agreed on Friday to take stronger measures to try to bring the worst outbreak of Ebola under control and prevent it spreading outside the region, including steps to isolate rural communities ravaged by the disease.

The World Health Organization and medical charity Medicins Sans Frontieres said on Friday the outbreak, which has killed 729 people in four West African countries, was out of control and more resources were urgently needed to deal with it.

WHO chief Margaret Chan told a meeting of the presidents of Guinea, Liberia and Sierra Leone - the countries worst affected - that the epidemic was outpacing efforts to contain it and warned of catastrophic consequences in lost lives and economic disruption if the situation were allowed to deteriorate.

"The presidents recognize the serious nature of the Ebola outbreak in their countries," Chan said after the meeting. "They are determined to take extraordinary measures to stop Ebola in their countries."

In a communique after their talks, the leaders agreed to deploy security forces to isolate the frontier regions where 70 percent of the 1,323 cases have been detected.

They banned the transportation of anyone showings signs of disease across borders, and pledged to introduce strict controls at international airports to prevent the virus spreading outside the region.

There was international alarm last week when a U.S. citizen died of Ebola in Nigeria - Africa's most populous country - after flying there from Liberia. Two people quarantined in Lagos after coming into contact with him were released on Friday after they tested negative for the disease.

The three leaders also agreed to step up efforts to protect local healthcare workers and encourage them to return to work.

With healthcare systems struggling to cope with the highly infectious disease, which requires rigorous precautions to stop it spreading, more than 60 medical workers have lost their lives, hampering efforts to tackle the outbreak.

Liberia has already put in place tough measures including closing all schools and some government departments. Sierra Leone on Wednesday declared a state of emergency and called in troops to isolate Ebola victims.

However, Friday's agreement marked a reversal by Guinea, which had previously resisted taking tough steps, saying the disease was under control there.

"Somewhat drastic measures will be taken," Guinea's Cooperation Minister Moustapha Koutoub Sano said. "These (border) prefectures and communities will be isolated."

EMERGENCY COMMITTEE

The outbreak has prompted some international organizations to withdraw. The U.S. Peace Corps has said it was withdrawing 340 volunteers from Liberia, Sierra Leone and Guinea.

U.S. aid group Samaritans Purse said on Friday it would complete the evacuation of its 60 international staff from Liberia over the weekend. It said two American staff who contracted the disease in Liberia were in a serious condition and would be medically evacuated by early next week.

Charity WaterAid said on Friday it was suspending its operations in Liberia as well.

The WHO is launching a $100 million response plan and the United States is providing material and technical support to the three countries. Further assistance will be discussed at a U.S.-Africa summit in Washington next week.

Guinea President Alpha Conde told Reuters he would represent Africa in those Ebola talks. Sierra Leonean President Ernest Bai Koroma and Liberia's Ellen Johnson-Sirleaf announced this week they would remain at home to tackle the crisis.

Chan appealed on Friday to the wider world to provide more medical experts and funding. She pledged to take personal responsibility for coordinating international response efforts and mobilizing the vast support needed to fight the virus, which can kill up to 90 percent of those infected.

The fatality rate in this epidemic is about 60 percent.

The WHO has convened an emergency committee on Aug. 6-7 to decide if the outbreak constitutes a public health emergency of international concern and to recommend measures to tackle it.

"The demands created by Ebola in West Africa outstrip your capacities to respond," Chan told the presidents.

Chan said cultural practices such as traditional burials and deep-seated beliefs were a significant cause of the spread and needed to change. In the final stages, its symptoms include external and internal bleeding, vomiting and diarrhea - at which point Ebola becomes highly contagious.

On Friday, the government of southeastern Nigeria's Anambra state quarantined a mortuary containing the body of a Nigerian man who died in Liberia while tests were conducted to determine the caused of death.

TECHNOLOGY WAR: Microsoft sues Samsung in U.S. over patent royalties

(Reuters) - Microsoft Corp (MSFT.O) sued Samsung Electronics Co Ltd (005930.KS) on Friday, claiming the South Korean smartphone maker refused to make a royalty payment last fall on patent licenses after Microsoft announced its intention to acquire Nokia's (NOK1V.HE) handset business.

The Microsoft lawsuit, filed in a Manhattan federal court, seeks monetary recovery from Samsung but does not publicly disclose the amount in dispute.

In a blog post on Friday, Microsoft deputy general counsel David Howard wrote that Microsoft "values and respects our partnership" with Samsung, but differs with Samsung over how to interpret the licensing agreement.

"Unfortunately, even partners sometimes disagree," Howard wrote. In a statement, Samsung said it will review the complaint "in detail" and determine an appropriate response.

Microsoft is trying to compete in the mobile market with products that run on Google Inc's (GOOGL.O) Android operating system. As part of that landscape, Microsoft has tried to raise the costs for Android handset makers by convincing them to pay Microsoft patent royalties.

Most large handset makers, such as Samsung, LG (066570.KS) and HTC (2498.TW), have agreed to pay. Motorola is one of the main holdouts, and that company has been in litigation against Microsoft since 2010.

Samsung made its royalty payments to Microsoft during the first fiscal year after they signed their 2011 agreement, the lawsuit said. However after Microsoft announced the Nokia deal last year, Samsung initially refused to make another payment, the lawsuit said.

In refusing to pay Microsoft, Samsung argued the Nokia deal breached its licensing agreement with Microsoft, the lawsuit said. Samsung eventually paid Microsoft late, the lawsuit said, but has refused to pay interest.

Samsung also claims smartphone products sold by Microsoft after the Nokia deal are not covered by the licensing deal, the lawsuit said. Microsoft has asked a judge to make an opposite finding.

The lawsuit in U.S. District Court, Southern District of New York is Microsoft Corp vs. Samsung Electronics Co Ltd, 14-6039.

TECHNOLOGY NEWS: Facebook restores service after outage in many countries

SAN FRANCISCO (Reuters) - Facebook Inc said service to the world's largest online social network was fully restored on Friday, following a widespread outage that affected users in multiple countries.

"Earlier this morning, some people had trouble accessing Facebook for a short time. We quickly investigated and have fully restored service for everyone. We're sorry for the inconvenience," Facebook said in an emailed statement.

Facebook, which has 1.32 billion monthly users, is still investigating the incident, but all signs suggest a "technical" failure rather than any suspicious activity, said a person familiar with the matter who requested anonymity because the probe is private.

Some visitors to the site on Friday were greeted with a message that read "Sorry, something went wrong. We're working on getting this fixed as soon as we can."

It was not immediately clear how widespread the disruption was, though Reuters was aware of users having trouble accessing the site in the United States, Chile and India.
